Jharkhand government approached SC over delay in appointment of permanent Chief Justice in HC

New Delhi:

The Jharkhand Government has approached the Supreme Court over the issue of delay in the appointment of a permanent Chief Justice in the Jharkhand High Court. The Soren government of the state has pleaded in its petition to initiate a case of contempt of the Supreme Court Collegium’s recommendations against the central government.

On July 11, the Supreme Court Collegium had recommended the appointment of Justice MS Ramachandra Rao as the Chief Justice of Jharkhand High Court. However, the central government has not yet given any response on it. Justice Sujit Narayan Prasad is serving as the acting Chief Justice of Jharkhand High Court.

Petitioner Jharkhand government, citing the Memorandum of Procedure, said that the responsibility on the acting Chief Justice should not exceed one month.

Justice Sarangi remained the Chief Justice of Jharkhand for 15 days

Also, the petition states that last time too, the Supreme Court Collegium had recommended Justice BR Sarangi, a judge of the Odisha High Court, to be made the Chief Justice of Jharkhand High Court on 27 December 2023, but the central government approved his appointment on 3 July 2024 after a delay of seven months. Justice Sarangi remained the Chief Justice for only 15 days and retired on 19 July. Since then, the acting Chief Justice is handling the work there.

The state government says that the Supreme Court Collegium started the process for the appointment of the new Chief Justice in time and also sent the recommendation, but due to the central government everything got delayed.
