"It's a personal choice...": High Court on not getting land to bury Akshay Shinde

Mumbai:

Hearing was held again in Bombay High Court today in the case of Akshay Shinde killed in Badlapur encounter. It is alleged that even after his death, Akshay Shinde did not get two yards of land for the last rites. Earlier, after the protest in Badlapur, there were preparations to bury him in Ambernath tomorrow. But there too, due to opposition from MNS, the Municipal Corporation has refused citing law and order reasons.

The government lawyer told the court that two officers have been deployed outside the accused’s house to prevent any untoward incident. As far as burial is concerned. We have been successful to some extent. But the petitioner’s lawyer has publicly stated that there is no practice of burying dead bodies among them. But he wants the body to be buried only so that the body can be taken out after the change of state government.

On this, Justice Revati Mohite-Dere expressed displeasure and said, what is this? Why are lawyers giving speeches? Lawyers should remain connected to their profession. We don’t understand why he gives speeches outside. Our endeavor is to ensure that only truth prevails.

The petitioner’s lawyer denied making any such statement. On not allowing the burial, the government lawyer said that senior members of the society were also opposing the burial. The justice said that no one can decide how the dead body should be disposed of. It is a personal choice. Let them dispose of the dead body the way they want.

After the Bombay High Court raised questions on the police in the Badlapur encounter case, now the lawyer of accused Akshay Shinde has said that there is a threat to the life of the family. Lawyer Amit Kataranvare, during a press conference on Thursday, demanded security for him and Akshay Shinde’s family members. He had also demanded the administration to make arrangements for Akshay’s last rites.

The Bombay High Court on Wednesday asked many serious questions to the Maharashtra Police regarding the killing of rape accused Akshay Shinde in the Badlapur encounter in Maharashtra. Raising questions on the working style of the police, the court said, “The police are duly trained to deal with any situation. In such a situation, it is natural to raise the question that how did the accused get shot on his head? It is taught in regular training as to which part of the accused to shoot at. In such a situation, the police should have shot at the leg or hand of the accused.”
